These Terms of Service (the "Terms") govern your use of the Artlayne Network application ("Artlayne" or "application" or "platform" or "Service"), an online professional networking platform for artists to connect to fellow artists and organizations, promote and explore. By accessing or using the Services, you agree to comply with and be bound by these Terms. If you do not agree with any of these Terms, you must refrain from using the Service.
Artlayne provides a range of services that include computational, data processing, and software tools to enable users to create, connect, promote, communicate, explore, collaborate and all other offerings that the platform provides for users. These Services are accessible through Artlayne. We reserve the right to modify, suspend, or discontinue any aspect of the Service at our discretion.
A "Beta Service/Version/Software" refers to specific features or functionality of Artlayne that we release to users for testing or evaluation purposes. Beta Services may be available only to a selected group of users, based on our preference or through invitations or notifications. As a participant in the Beta Service, you acknowledge that the features may be in a pre-release state and subject to changes. Artlayne reserves the right to terminate or modify Beta Services at any time without prior notice.
To access certain features of the Artlayne application, you must sign up for an account. By signing up, you agree not to engage in fraudulent, malicious, or harmful activities while using the Service. This includes, but is not limited to, using Artlayne to generate content that may humiliate, harm, or defame others. Artlayne reserves the right to terminate your account and access to the Service if you violate any of these terms.
As a user of Artlayne, you agree not to use the Service for spamming, misleading others, or engaging in any illegal activities. You also agree to refrain from using the Service for malicious purposes or any activities that may harm the integrity of the platform or the experience of other users. If we detect any such activity, we reserve the right to suspend or terminate your access to Artlayne at our sole discretion.
Artlayne (if not now, in future) offers various service packages, and the pricing for each package is determined solely by Artlayne. We reserve the right to change the pricing of any package at any time. Payments for the services are processed through third-party payment providers. Any disputes or issues related to payments must be addressed with the third-party provider, and Artlayne is not responsible for resolving payment-related concerns.
Any content or data (including text, images, and other material) provided by the user on the Artlayne platform remains the sole property of the user. As the user, you retain ownership of the data you submit, and you are free to use, replicate, or distribute it as you wish. Artlayne does not claim ownership over the content you generate, but we do retain the right to use such content for internal purposes as specified in our Privacy Policy.
Artlayne reserves the right to delete or remove user accounts that have been inactive for a period exceeding 400 days. We may also remove any associated content or data if deemed necessary. We will provide prior notice of any such action, but it is the user's responsibility to maintain activity on the platform.
By creating an account on Artlayne, you agree to provide accurate and up-to-date personal information as required during registration. Artlayne reserves the right to modify, update, or revise these Terms at any time. Any changes will be communicated to you via the platform or email, and you will be required to accept the updated Terms in order to continue using the Service.
Artlayne may, at its sole discretion, suspend or terminate your access to the Service for any reason, including but not limited to a violation of these Terms. In the event of termination, you may lose access to your content, data, and any ongoing subscriptions or services.
To the maximum extent permitted by law, Artlayne shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use or inability to use the Service, including but not limited to any loss of data, loss of revenue, or other economic damages.
These Terms shall be governed by and construed in accordance with the laws of Indian Jurisdiction, without regard to its conflict of law principles. Any legal actions or proceedings arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Artlayne DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPLETELY SECURE. YOU USE THE SERVICE AT YOUR OWN RISK.
You agree to indemnify, defend, and hold harmless Artlayne, its affiliates, employees, agents, and partners from and against any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from or in connection with:
Artlayne reserves the right to assume exclusive defense of any matter subject to indemnification, and you agree to cooperate fully with Artlayne in the defense of such claims.
Artlayne retains all rights, titles, and interests in and to the Service, including but not limited to its software, technologies, designs, logos, and other intellectual property. These Terms do not grant you any rights or licenses to use Artlayne' intellectual property, except as expressly permitted for the purpose of accessing and using the Service. Any content generated by you using the Service remains your intellectual property, subject to the rights and licenses specified in these Terms.
